Licence terms

The conditions under which you may use Monitile, in the free version and in the Pro version. They are written to be read: where the law requires a formula, the formula is there, but the rest is in plain English.

In short

  • You buy a perpetual licence to use the software, not a subscription. You pay once.
  • You may install it on every computer you use. We do not count devices.
  • The key is personal: it must not be shared or resold.
  • You have 14 days to change your mind, with no need to explain why. See the refund policy.

The rest of this page says the same things with the precision needed in case of a dispute.

Who sells you what

Monitile is developed and licensed by Tommaso Mele, Via Isonzo 76, 73010 Veglie (LE), Italy, VAT number IT05201950754 ("the licensor"), who can be contacted at info@monitile.app.

The Pro licence is purchased through Freemius, which acts as Merchant of Record: it is the seller towards you, it collects the payment, it fulfils the VAT obligations and it issues the sales document. For payment and invoicing purposes, Freemius's own terms therefore apply as well.

The right to use the program, governed by this page, is instead granted directly by the licensor.

The licence you are granted

With your purchase you receive a perpetual, personal, non-exclusive and non-transferable licence that allows you to install and use Monitile Pro:

  • on every computer of which you are the user, with no limit on their number — the laptop, the desktop, the one at home and the one at the office, as long as you are the one using them;
  • for an unlimited time, with no renewals and no recurring fees;
  • for personal or professional purposes alike.

The criterion is personal use, not a count of machines: one licence covers you, not a number of installations. If the program is to be used by several people, each of them needs a licence.

The program remains the property of the licensor: what you buy is the right to use it, not the software itself nor the rights relating to it.

What you may not do

  • Share, publish, sell or give away the licence key. It is the one prohibition we truly care about.
  • Resell, rent out or distribute the program, or include it in another product intended for sale.
  • Remove or alter the authorship notices and the licence information contained in the program.
  • Circumvent, disable or tamper with the checks that distinguish the free version from the Pro version.

The rights that the law grants you in any event remain unaffected, including those provided for by articles 64-ter and 64-quater of the Italian Copyright Act (Law 633/1941) concerning back-up copies, studying how the program works and interoperability. No clause on this page can restrict them.

The licence key

The key you receive by email is issued in the name of your email address, which the program shows in the Licence section. It must not be shared with other people: each person needs a licence.

Verification happens on your computer, with no connection to external servers. There are no activations to use up and no reinstallation limits: if you change computer or reinstall Windows, enter the same key again.

Keep the email that delivered it. If you lose it, write to info@monitile.app from the address used for the purchase and we will send it again.

The trial period

When the program is first started, the Pro features are active for fourteen days, without you having to buy, register or provide any data. It is a free concession: it places no obligation on you and it creates no contractual relationship.

When it expires, the three Pro features switch off and the program carries on in the free version, with no further limitations and without losing the data or the sessions created during the trial.

The length of the trial may change in future versions of the program. Such a change does not affect anyone who has already bought a licence.

The free version

The free version of Monitile is provided at no charge and with no expiry. You may use and install it freely, subject to the same limits set out above regarding redistribution and modification.

Being free, it is provided as is: there is no commitment to provide support or continuity of service, without prejudice to what the law grants in any event to those who use it.

Updates

Monitile updates are included in the licence: fixes and improvements to the Pro version are yours at no extra cost.

This does not entail any obligation to develop specific features or to release updates on a set schedule. If a substantially new and distinct product were published in the future, it might be offered separately: in that case your licence would in any event remain valid for the version you bought.

Legal guarantee of conformity

If you buy as a consumer, you are entitled to the legal guarantee of conformity provided by the Italian Consumer Code for digital content: the program must match its description and be fit for its intended purpose. In case of a defect you are entitled to have conformity restored and, where the conditions are met, to a price reduction or to termination of the contract.

This guarantee is independent of the voluntary 14-day refund policy and is not limited by it: it also applies after that period has ended.

System requirements. Monitile requires 64-bit Windows 10 or Windows 11. It is not guaranteed to work on other versions, on modified systems or alongside programs that interfere with window management. Some known limitations — for example File Explorer folders not being reopened, or the impossibility of moving the windows of programs run as administrator, which Windows prevents — are documented in the guide and do not constitute defects.

Liability

Monitile moves and reopens windows: it does not modify, delete or transfer your documents. It is nonetheless a program that acts on the system, and it is reasonable for liability to be defined.

To the extent permitted by law, the licensor is not liable for indirect damages, loss of data or loss of profit arising from the use or inability to use the program. In any event, any liability is limited to the amount you paid for the licence.

None of these limitations applies in case of wilful misconduct or gross negligence, of personal injury, or where the law prohibits them. If you are a consumer, your mandatory rights remain intact: this page cannot reduce them.

Duration and termination

The licence is perpetual and does not expire. It ends in two cases only: if you obtain a refund of the price, or in case of a serious breach of the prohibitions set out above — in particular, spreading the key.

If the licence ends, you must remove it from the program; you may of course carry on using the free version.

Changes, governing law and disputes

These terms may be updated to reflect changes to the product or to the law. Changes apply to purchases made after publication: the licence you have already bought remains governed by the terms in force at the time of purchase.

The relationship is governed by Italian law. If you buy as a consumer, the mandatory provisions — including those on jurisdiction — of the State in which you reside continue to apply, and for disputes in Italy the competent court is that of the place where you reside or are domiciled.

Before going to court, write to info@monitile.app: almost everything is settled with an email. The possibility of turning to the alternative dispute resolution bodies provided for by current legislation remains unaffected.
